1. Who this is between. This Demo Access Agreement is between Build Smart ("Build Smart", "we") and you, and the company you represent ("you"). By checking the box and clicking "Agree and open the demo", you accept it on your own behalf and on behalf of that company, and you confirm you have the authority to do so.

2. Evaluation only. We give you a limited, personal, revocable, non-transferable, non-exclusive permission to use the demo, including the walkthrough video, only to decide whether your company will buy Build Smart. The demo contains sample data only. Do not enter real company, project, or personal information.

3. What you may not do. You may not, and may not help anyone else: (a) copy, reproduce, sell, resell, license, or distribute any part of Build Smart, including its software, screens, designs, layouts, workflows, features, text, reports, data structures, or documentation; (b) record, screenshot, download, or capture the demo or the walkthrough video for anyone outside your company, or publish any such capture; (c) reverse engineer, decompile, scrape, crawl, or use automated tools on Build Smart; (d) use anything you see in the demo to build, design, specify, or market a product or service that is similar to or competes with Build Smart, or describe it to anyone who does; (e) share your demo access with anyone else; or (f) try to get around any security, limit, or block in the demo.

4. Ownership and confidentiality. Build Smart and everything in it, including all copyrights, trade secrets, trademarks, and other intellectual property, belong only to Build Smart. Nothing in the demo is transferred or licensed to you except the limited evaluation permission above. You will keep everything you see in the demo that is not public confidential, and use it only to evaluate Build Smart. If you give us feedback or ideas, we may use them freely.

5. Ending access. We may end or limit your demo access at any time. Your obligations under "What you may not do" and "Ownership and confidentiality" continue after your access ends.

6. Remedies. You agree that breaking this agreement would cause Build Smart serious harm that money alone cannot fix, so Build Smart may ask a court for an injunction to stop it, in addition to any other remedy, including damages and recovering reasonable attorney's fees.

7. No warranty. The demo is provided "as is" for evaluation, without warranties of any kind. To the extent the law allows, Build Smart is not liable for any damages from your use of the demo.

8. Law and where claims are brought. This agreement is governed by the laws of the United States, including the U.S. Copyright Act and the Defend Trade Secrets Act, and, for anything federal law does not cover, by the laws of the State of Oklahoma. Build Smart may bring a claim to enforce this agreement in any state or federal court in the United States that has jurisdiction, including the courts where you or your company are located, and you consent to the jurisdiction of those courts. Clicking "Agree" is your electronic signature, and we keep a record of your acceptance, including the date, time, IP address, and the version of this agreement.
